The Washington Post (WP) and CNBC reported on the 29th that a legal battle between Musk and Twitter over the termination of Tesla CEO Elon Musk’s takeover contract will be held for five days from October 17th.
According to reports, the Delaware State Court of Equity has released the trial schedule for the lawsuit between Twitter and Musk on the same day.
Musk filed a counter-suit against Twitter after the trial date was confirmed. Musk filed a 164-page complaint, but the contents were not disclosed.
Previously, Musk signed a contract to acquire Twitter for $44 billion in April, but on the 8th, announced that it was abruptly terminated.
In response, Twitter filed a lawsuit against Musk demanding enforcement of the acquisition agreement.
In the trial, the court will decide whether Musk should continue to fulfill the deal or whether Musk can withdraw from the deal because it believes that Twitter has breached its contractual obligations.
The biggest issue in the lawsuit is whether the status of fake accounts can be grounds for contract termination.
Although Twitter maintains that around 5% of active users are fake accounts, Musk withdrew the takeover offer, accusing Twitter of hiding information about the fake accounts.
